He says this might not always be the best option out there.

"Just the thought of being debt-free can bring tears of relief to a family who has been under high interest payments for years," says Absolute Debt Solutions Founder and CEO Tom Bates. "Studies show that 78% of all income is paid out to debt of some type, with the major percentage of each payment going toward interest."

Bates lists the types of debt settlement options available and offers some insights:

~ Consumer counseling services -- These services operate by setting clients up with their own personal counselors. Only after clients have paid an enrollment fee and agreed to automatic bank drafts, will the program go into effect. The counselor then contacts the client's creditors and attempts to lower their interest rates. But, this is often only lowered temporarily. Should the client or the counselor be late in getting the payment to the creditor, that low interest rate will return to its previous high rate. Often these services appear to be non-profit, however that is most often not the case. An article from the Cincinnati Post titled "Wolves in Credit Counselors' Clothing" (April 26, 2005) found Clients of the California-based National Consumer Council, Florida-based Debt Management Foundation Services Inc. and Massachusetts-based Better Budget Financial Services Inc. paid thousands of dollars to keep bill collectors at bay, but instead clients saw their debts, interest rates and late fees increase as the three companies did little to help. Often, these services will follow up with the creditor with a letter of counsel that informs them of the client's involvement in their program and asks them the work with them, and to proffer a fair-share contribution. Ultimately, the money a client pays should be going to the creditors first, not the counseling service.

~ Debt Consolidation is always a great way to bring resolve to debt as long as clients have a process in place before the consolidation to settle the debt. If there is no procedure in place to discount the amount owed, there is no real reason to conduct a consolidation loan. Lowering the monthly payment is somewhat beneficial, but the end result may not be what is desired. A simple trade out of loans does not lower the amount owed or monthly payment, and in most cases, clients are going to end up owing double what they started with. About 80% of borrowers use debt consolidations loans, bringing accounts to a zero balance, but end up owing another lender at a lower or longer rate/term. In most cases, people that go through debt consolidation will continue to use the accounts that were paid off, resulting in double the debt. The end result is, if clients have a well qualified debt settlement company that will charge a fee based on results, they should handle all the negotiations before the debt consolidation and then they are sure to come out on top.

~ With Fee based Debt Settlement, there are many options, and in several ways, consumers can save money. If it is a buffer or shield type, clients are always in better hands with creditor experts that are IAPDA certified and have been in the collection and or credit industry. These creditor experts understand the creditor and the individual account better than an average debt settlement company. Further, the fees charged by fee based debt settlement companies are going to cost about 15% of the total debt. So whatever is advertised, add about 15 % to their quote, and in most cases, the fee is paid up front before the job is done or even started. If they are not willing to give a written guarantee to perform and produce, potential clients should reconsider doing business with them, regardless of their affiliation or ratings. The old saying, "if it is not in writing, it didn't happen" applies here. The truth is, there is only one type of guarantee that will protect the consumer. When it comes time to perform the actual service, most of the money clients have saved over the months or years has gone to the debt settlement company, leaving little or no money for settlement. This method does not seem to have the consumer's best interest in mind, as the debt settlement company gets paid before the creditor. One of the largest debt settlement companies just had a class action law suit filed against it, for the practice of collecting fees but not providing services. Along with this law suit, there are over 700 BBB complaints filed for actions truly not in the consumer's best interest. Not all fee based debt settlement companies act like this; some put their client's best interests first.

Court Decision Announced By Travelers Insurance

Travelers Announces Court Decision Regarding Statutory and Common Law Direct Actions

SAINT PAUL, Minn.- February 19, 2008 -The Travelers Companies, Inc. (NYSE: TRV) today announced that the U.S. Court of Appeals for the Second Circuit has vacated the March 2006 decision of the U.S. District Court for the Southern District of New York that had approved Travelers' previously announced settlements of statutory and common law asbestos-related direct action litigation.

The settlements are subject to final court approval of an order that enjoined further direct action litigation against certain Travelers entities. The Second Circuit's decision found that the court originally issuing that order did not have the jurisdiction to do so. Travelers is currently analyzing the Second Circuit's opinion to determine whether to pursue further appellate proceedings. In addition, other parties may seek further appellate review of the ruling.

Travelers will not make an adjustment to the level of its asbestos reserves as a result of the Second Circuit's decision. Accordingly, the decision does not impact Travelers' earnings.

Travelers would have preferred the finality afforded by the settlements and related injunction. However, since Travelers entered into the settlements, there have been court decisions upholding defenses similar to those asserted by Travelers in the common law direct action litigation. In addition, the asbestos litigation environment has improved generally over the past several years. As a result, Travelers' current outlook for the overall direct action litigation is more favorable than it was when Travelers entered into the settlements. If the Second Circuit's decision becomes final, the settlements will become voided and Travelers intends to litigate the direct action cases vigorously.

Mesothelioma Trial Attorneys Fight Against Asbestos Exposure In New York

New York, NY (PRWEB) January 4, 2008 -- On December 17, 2007, a New York City jury awarded a total of 9 million dollars to compensate two New York City mesothelioma victims and their wives for damages caused by asbestos exposure. The two cases (Rosenberg and Casale) were joined for a single trial before Justice Marcy S. Friedman, Supreme Court, New York County, located in downtown New York City. The jury verdicts in these cases are being viewed as ground-breaking by mesothelioma trial attorneys, as the verdicts were handed down against companies against whom no jury verdicts had ever been returned in the long history of asbestos exposure litigation in New York City.

The case of Joel and Sharon Rosenberg v. Alpha Wire Company, et. al, Index No. 106697/06 involved the asbestos exposure that Mr. Rosenberg sustained as the result of working as a life-long electrician in New York with the International Brotherhood of Electrical Workers ("IBEW"), Local 3. Mr. Rosenberg started in the trade while still a teenager in 1960. He suffered asbestos exposure while working in New York as an electrician. Mesothelioma due to workplace asbestos exposure developed in Mr. Rosenberg from a variety of New York worksites including the Arthur Kill Powerhouse in Staten Island, the Vista Hotel in the Financial District, the Cross Bay Bridge and the Deutsche Bank Building. Mr. Rosenberg, sustained asbestos exposure in the workplace from a variety of sources including the cutting, sawing and skinning of wire and cable that was insulated with asbestos.

In the Rosenberg case, the New York jury returned a verdict in favor of the Rosenberg's against a manufacturer of asbestos-containing power cable. This represents the first verdict against a manufacturer of cable used in a commercial setting in the history of asbestos exposure litigation in New York. The jury awarded $3 million for Mr. Rosenberg's pain and suffering and $1 million to Mrs. Rosenberg for loss of services and society. Mr. Rosenberg developed mesothelioma during his retirement while living in New Jersey. He died at the age of sixty-four.

The Casale case (Joseph and Dolores Casale, Index No. 104299/06), involved the asbestos exposure of Mr. Casale during his career as a steam fitter (also known as pipe fitter) in New York. At the time, steamfitters were unknowingly endangered with asbestos exposure in their workplace due to asbestos being used on equipment such as valves, steam trap and boilers. While still a teenager Mr. Casale worked at shipyards, including the Brooklyn Navy Yard, as a member of the Local 638 Union. Mr. Casale continued in the same union and worked in the steam fitter trade at job sites in New York City throughout the 1960s and 1970s. Mr. Casale later moved to Florida but his mesothelioma diagnosis was linked to his asbestos exposure which occurred in New York. Mr. Casale was exposed to asbestos from various products including valves and steam traps, from both internal asbestos components and asbestos insulation that was applied to the products.

The jury awarded a total of 5 million dollars in the Casale case: 1.5 million for Mr. Casale's pain and suffering up to the date of the verdict; 1.5 million for Mr. Casale's future pain and suffering; 1 million for Mrs. Casale's loss of service and society up to the date of the verdict; and 1 million for Mrs. Casale's future loss of service and society.

In the Casale case, the New York jury returned a verdict in favor of the Casales against a manufacturer of valves, as well as a manufacturer of steam traps. This represents the first verdicts involving valves and steam traps in the history of asbestos exposure litigation in New York, and is reportedly the first asbestos verdict in the nation involving the use of steam traps.

Mr. Casale, who is living with mesothelioma at age of 66, testified at trial.

Domain Parking? Just Add Water!

I'm doing some testing of one domain over at http://www.WhyPark.com. I thought I should give them a fair test and not just judge them on the basis of the fee they charge. One the one hand, paying $100 to park up to 100 domains is not cheap, especially if your domains are junk and are not getting any traffic. Even if WhyPark is great, it's going to take some time to get some traffic and earn some money. Still, paying for a hosting account that will let you put up 100 sites and all the time it's going to take is not trivial. But that's not what this post is about.

Tonight I got a comment on one of my blogs and it was a spam comment. They found my post about WhyPark and I guess they didn't like it, because they made a somewhat cryptic comment to the effect that Instant Website was better. So, after I deleted the spam and posted a reply, I went over to IW and thought I would give it a try. I opened an account and set up a test using a domain they provided:

I don't know how long that will stay up, and I decided to not do a screenshot. But I'll tell you that while their site may actually be effective, they look like crap and I would be embarrassed to say one was mine...! At first they don't seem too bad, but they take what looks like magazine articles on good topics, and then put other spam crap in dim faded text in every other paragraph. Do a search for a topic that has nothing to do with the site and then look at the articles. It looks like a site of a a mad person, or some of the really old spam content sites we used to see on GEOCITIES and TRIPOD years ago.

I don't know, I guess it's worth a try if you think it's for you. I guess you have set your DNS to point to their site before you can get a "credit" and setup your site for real. So it doesn't seem to cost anything, they have some ads on the site that are theirs and that is how they expect to make money. There has been some discussion on Namepros.com about this service that you pay about $100 dollars for and that allows you to set up as many as 100 domains. As an alternative to domain parking there system allows you to enter in some information including some ad network code like AdSense, and quickly set up something like a web site that pulls in articles that are on the topics for keywords that you choose.

For my test, I selected the domain
http://www.music-download-universe.com that has been parked for several months and earned perhaps a dollar. I choose this domain name because it does get a lot of traffic, so I won't have to wait, but also because it gets few clicks and those clicks pay very little.

The setup is about the same as a parking page where they provide you with options to customize your parking pages. Unlike parking, there did not seem to be any defaults, so if you have a lot of domains you are going to be spending time getting each domain name set up. The good news is that each site should not take you long one you get started. They include a tool to help you find keyword for you domain and it looks like the data may be coming from WordTracker, but I could not tell. The search terms have numbers so you can see what it popular. I added "free music downloads" and a few other related phrases.

Then there are two areas where you can enter in your ad network code. I added normal AdSense at first and then after thinking about it I pulled that out and replaced it with the AdSense for referrals. This works much the same, but I think there are more interesting ads and many of them can pay you a LOT more than normal AdSense. I picked some categories for music/entertainment and consumer electronics.

I may experiment with this and see just what I can get away with in the manner of creative coding such as links and iframes... Since you just pay for the service once, I don't think WP will care unless you create sites that look trashy or broken, or cause problems for their servers.

You can choose a number of domain templates and customize one as well. You can also add new pages. I will see how the basic setup goes and then consider doing more work on my site. You will find they sites look much like what we are used to from Made For AdSense (MFA) sites, so adding a contact, about, and other pages could "round out" the site so it really looks like a site. One of my suggestions will be to WP that they offer pre-configured pages like an about and contact page for users to make this easier. I would like to create one page of content for an about page and then have that as a default that I can edit on a site by site basis.

Winding up for now, there was on feature that was something I just suggested on the forums the other day. When domainers buy and sell domains, there doesn't seem to be any way to easily transfer the domain within a parking service. You must contact support and have them verify you are now the owner of the domain and then you can set it up under your account. It would be a big plus to be able to transfer the domain parking page set up to the new owner so they can easily maintain the current earnings. WhyPark has this option now for site owners. Yes, you do have to open an account with WhyPark, but at least you don't have to re-create all the settings and start from scratch. I would like to see WP charge the new domain owner $1 for the transfer of the domain name to their account. That way they would not be forced to pay the full fee for something they may not really want, but there would be some incentive for them to leave the domain with WP which may not provide much income, does provide continued advertising for their system.

Citizen Hawk Service Upsetting Domainers

CitizenHawk, Inc. is sending out emails to domainers that they feel are infringing on the trademarks of some companies. Domainers that get emails from them are upset in part because they come on so strong and are demanding that the domainer turn over the domain to Citizen Hawk. Many domainers think this is a scam since they are being asked to turn over their domains.

While not exactly a scam, it seems to be a service that may or may not be legal. Unless the Squawker has been authorized to act in the behalf of the trademark holder, they may not have any right to do what they are doing.

On the other hand, there is nothing wrong with  providing a service that goes after those that may be abusing a trademark.

My concern is that there are some cases where a trademark may be involved but no abuse is taking place, such as a domain like Xboxforums.org. If a site is not doing things that should be considered abuse, will they still be targeted? My advice to companies is to go easy on those that may be loyal and good customers at first. You can always get tough later on if you find real signs of abuse and infringement.

Frankly, I could see this area ripe for a different kind of service that provided not only a policing service, but also one that offers education as well. Many new domainers start buying domains and do not realize that they may be potentially infringing on a trademark. After all, if you find some valuable land that no one owns, but that they could have staked a claim in and didn't, it doesn't seem likely that they are interested in it.

Ebay had the right approach last year when they sent out thousands of emails to people that registered different variations of the word "ebay". Rather than pay a lawyer to get all nasty, they simply notified people that they were being put on notice and that they should not use, sell, or renew any domain with their trademark. The implication was that if the advice was not followed, they would come after you and you were not going to like the encounter...
